Bespoke Wedding Dresses Terms and Conditions

  1. General
    1. These terms and conditions constitute the conditions upon which Blanco Bridal Couture (Pty) Ltd and its agents (“Blanco”) is to supply goods and services, including but not limited to custom wedding dresses, bridal accessories, wedding dress accessories, alterations, cleaning, steaming and preservation of dresses and veils (the “Goods” and/or “Services”) specified in the quotation sent to the customer.
    1. No variation, amendment or addition to these conditions shall be binding on either party unless agreed in writing between a director of Supplier and the Customer.
    1. No forbearance or delay by Blanco in or before enforcing these terms shall prejudice its rights. No waiver of any right or breach of these terms shall be effective unless in writing and signed by the party making the waiver and any such waiver shall not be construed as a waiver of any other right or breach.
    1. Unless otherwise agreed to in writing by the parties, the terms and conditions contained herein will supersede all prior representations and agreements. 
    1. In the event that there is any discrepancy between these terms and conditions and the terms and conditions which may appear on the Blanco’s website and/or quotations, these terms and conditions will supersede the aforementioned.
    1. It is understood that the quotation read with these terms sets out the entire agreement and understanding between the parties.
  1. Definitions 
    1. “Customer” shall mean any person (natural or juristic) to whom Blanco provides Goods and/or Services.

 

    1. “Confidential Information” shall mean information confidential and/ proprietary in nature, including but not limited to, trade, financial, sales, contractual, technology and management secrets, special marketing information, ideas, know-how, technical know-how, product design and/or style specifications, exclusivity arrangements, designs, formulations and concepts originated by the disclosing party, not previously published or otherwise disclosed to the general public, not previously available to the receiving party without restriction, not normally furnished to others without compensation, and which the disclosing party desires to protect against unrestricted disclosure or competitive use, and which is furnished in writing pursuant to the rendering of the Services.
    1. “Intellectual Property” shall mean all current and future intellectual property rights of whatever nature in relation to or attaching to the Goods and Services, including, but not limited to, all vested, contingent and future patents, copyrights, data, designs, drawings, inventions, processes, know-how or techniques, trademarks, service marks and other rights of a similar character, whether or not the same are registered or capable of registration.
    1. “Parties” shall mean the Blanco, its agents, and the Customer. 
    1. “Blanco” shall mean Blanco Bridal Couture (Pty) Ltd and its agents and its sister companies responsible for rendering of the Services.
    1. Deposit” shall mean the non refundable deposit payable to Blanco, being a 70% deposit of the total amount stated at the time of placing the order. All deposits are non-refundable.
    1. Damage” shall mean, but not be limited to, stains, rips, tears, food and/or drink stains, permanent discolouration, spray tan and/or make-up stains and mud and/or dirt stains.
    1. “Goods and Services” shall mean the making of custom Blanco wedding dresses, bridal accessories, wedding dress accessories, alterations, cleaning, steaming and preservation of dresses and veils or other professional bridal services as rendered by the Blanco. 
    1. Minor damage” shall mean stains which are not permanent and can be removed by cleaning.
    1. Order date” shall mean the date on which the custom wedding dress is ordered by the Customer, which must be placed on at least 7 (seven) months’ notice. All rush orders shall be subject to an additional fee of R2800.00 (45 days without shipping)
  1. Customer’s Obligations
    1. The Customer is obliged, by the dates agreed between the Customer and Blanco, to:
      1. 3.1.1.Ensure that all measurements and specifications provided to Blanco are accurate. Any changes to the original measurements and specifications provided by the Customer will result in additional fees. Blanco is expressly not responsible for any changes in the Customer’s body shape or weight after the measurements have been taken by alternatively provided to Blanco. Any alterations to the dress due to such changes will be charged to the Customer separately;
      2. 3.1.2.Ensure that the desired style and fit of the dress is accurate. Any changes made to the design after the deposit has been made will incur additional fees;
      3. 3.1.3.Attend at least 3 (three) fittings to ensure that the dress fits correctly. Any additional alterations made thereafter will be at an additional cost to the Customer;
      4. 3.1.4.Attend a final fitting and collection at 2 days before the wedding date. Any delays in pickup or changes in the pickup date made with less than 2 (two) weeks’ notice may result in additional fees being charged to the Customer;
      5. 3.1.5.Make a 70% deposit at the time of placing the order;
      6. 3.1.6.Under no circumstances take photographs and/or videos during the fittings and consultations (inclusive of the Customer and/or its guests).
    1. Damage to the Goods:
      1. 3.2.1.It is expressly agreed that should the Customer or any third party cause any damage to the dress, that the Customer will be charged separately for any repairs effected to the dress as a result. This does not include wear or tear due to alterations needed on the dress;
      1. 3.2.2.In the event that the dress arrives faulty or damaged from the manufacturer, Blanco will repair the dress at no additional cost to the Customer.
  1. Fees and Payment
    1. The price quoted by Blanco is a based on the design, information, measurements and specifications provided to Blanco by the Customer and it is subject to change.
    1. On placing the order, the Customer is required to make payment of a 70% non refundable deposit of the total amount payable to ensure that the order is placed.
    1. The remaining balance is due when the dress is being shipped to South Africa. In this regard, the Customer will be notified by Blanco when the balance is due to be paid. The dress will remain the property of Blanco and will not be released to the Customer until payment in full has been received.
    1. Blanco shall not offer any refunds on custom dresses and shall be entitled to claim, inter alia, the full purchase price of the dress from the Customer in the event that the Customer breaches this agreement.
    1. Blanco and/or its agents reserve the right to amend any quoted amount in respect of any custom wedding dress in the event of:

 

      1. 4.5.1.Minor damage by the Customer or any third party;
      1. 4.5.2.Additional cleaning and/or preservation services required;
      1. 4.5.3.An alternative dress being required;

 

RENTAL TERMS AND CONDITIONS:

1. Measurement Accuracy & Fit

When you rent a wedding dress from us, we will take your measurements to ensure the best possible fit for the dress. By agreeing to the rental, you confirm that the measurements taken at the time of your fitting are correct.

•⁠ ⁠Please note that no significant changes to your measurements (either weight gain or loss) should occur after your measurements are taken and payment is made for the rental dress. If there is any change, the dress can only accommodate a difference of up to 2-3 cm.

•⁠ ⁠We are unable to alter the dress if your measurements change beyond this range. The dress cannot be taken in more than 2-3 cm, so it’s important that you are confident with the size at the time of fitting. If the difference is more than 3cm it will be seen as a permanent change and the bride will need to purchase the dress in full.

2. Care of the Dress

We want to ensure that you look stunning in your rented dress and that it remains in excellent condition for future brides. Therefore, we ask you to carefully follow these guidelines:

•⁠ ⁠No Spray Tanning: We strongly recommend no spray tanning or other similar treatments before wearing the dress, as these can permanently stain or damage the fabric. Any permanent stains or discolorations caused by spray tanning or similar activities will be treated as permanent damage, and the bride will be required to purchase the dress at its full retail price.

•⁠ ⁠Handling the Dress: Please take utmost care when handling your rented dress. If the dress is returned with permanent damage, including tears, stains, extreme mud/wine stains or alterations made without our consent, the bride will be responsible for purchasing the dress at full price. This ensures that the dress remains in pristine condition for others to enjoy.

3. Alterations

Alterations to a rented dress are only done at the Blanco Bridal Couture store by our sister company, Wedding Coutures contracted experienced seamstresses. This is to ensure that the integrity of the dress is maintained.

•⁠ ⁠No unauthorized alterations are allowed. If alterations are made without our consent, the dress will be considered permanently damaged, and the bride will be responsible for purchasing it.
•⁠ ⁠Any alterations made should be communicated with us in advance, and we will ensure that any necessary adjustments are made in line with the dress’s specifications.

4. Return Policy & Late Fees

We expect the rented dress to be returned (3 days after the wedding) in the same condition it was received.

•⁠ ⁠Late Returns: If the dress is not returned on the agreed-upon return date, a late fee per day will be applied.
•⁠ ⁠Cleaning: The bride is not allowed to have the rented dress dry cleaned herself as we have professional dry cleaners that cleans our dresses. If there are any stains or damages, we will assess the situation and may charge additional fees based on the extent of the damage.

5. Purchase of Damaged Dresses

We understand that accidents happen. However, if the dress is returned with permanent damage, including but not limited to stains, rips, or excessive wear, the bride will be asked to purchase the dress at full retail price. This will be indicated on the release form when you collect your dress. This policy ensures that the dress can be repaired or replaced, and maintains fairness for all future brides.

6. Deposit

On the day of collection, the bride is required to pay a deposit of R4000.00 into Blanco Bridal Couture’s account. This deposit will serve as a security measure for the rental of the dress. Additionally, a cleaning fee of R980.00 will be deducted from the deposit.
It is important to note that any damages to the dress will also be deducted from the deposit. In the event that the dress is permanently damaged and cannot be repaired, the bride will be responsible for paying the full retail price of the dress on the same day.
 
If there is no damages on the dress you will receive back the amount of R3020.00 within 7 working days from the day of the return of the dress.
 

7. Important Notes

•⁠ ⁠By proceeding with a rental, you agree that the measurements taken at the time of your fitting are correct, and that the dress cannot be altered beyond a 2-3 cm difference in size.
•⁠ ⁠⁠If excessive weight loss/weight gain occurs, it is seen as a permanent change and the bride will need to purchase the dress in full.
•⁠ ⁠Any permanent damage, whether caused by spray tanning, stains, or other accidents, will result in the bride having to purchase the dress.

Custom wedding dress

CUSTOM WEDDING DRESS TERMS AND CONDITIONS

1 All custom wedding dresses must be placed with at least six (6) months’ notice. Al rush orders will be subject to an additional fee of R2800.00.

2. All custom wedding dresses are made to measure, based on the measurements and specifications provided by the client. Any changes made to the original design after measurements have been taken will result in additional fees.

3 The client will be required to make a 70% deposit at the time of placing the order, with the
remaining balance due when the dress is on the way to South Africa. The bride will be notified by Blanco Bridal Couture when the balance is due. All custom dress orders will not be released until full payment has been received by Blanco Bridal Couture.

4. Any changes made to the design after the deposit has been made will incur additional fees. Al deposits are non-refundable.

5. The client is required to attend at least three (3) fittings to ensure the dress fits correctly, with any additional alterations at an extra cost.

6. Blanco Bridal Couture is not responsible for any changes in the client’s body shape or weight after the measurements have been taken. Any alterations required due to such changes will be charged separately.

7. The client must be available for final fitting and collection at least one (1) week before the wedding date. Any delays in pickup or changes in the pickup date made with less than two (2) weeks’ notice may incur additional fees.

8. In the unlikely event that the dress is faulty due to manufacturing, Blanco Bridal Couture wil repair the dress at no additional cost to the client. However, any damages caused by the client or a third party will be charged separately. This does not include wear or tear due to alterations needed on the dress.

9. Blanco Bridal Couture reserves the right to use images of the custom wedding dress in their portfolio, social media, and marketing materials.

10. Blanco Bridal Couture cannot guarantee any exclusivity on a custom dress order.

By placing a custom wedding dress order with Blanco Bridal Couture, the client acknowledges that they have read and understood these terms and conditions, and accepts them without reservation.

Accessories

Returns

Our return policy is valid for 30 days. If more than 30 days have passed since your purchase, we regret to inform you that we are unable to provide a refund or exchange.
Items being returned must be unworn, in pristine condition, and include the original packaging. Exchanges are dependent on stock availability. In cases where an item is out of stock, a store refund will be processed automatically. Returns will be completed only after the goods have been received and processed.

Customers are accountable for return shipping expenses. For secure returns, we suggest using a traceable carrier and insuring the merchandise for its full value. Please note that we are not liable for lost packages. Original or return shipping costs are non-refundable. In the event of an error on our part (such as damaged or incorrectly shipped items), we will reimburse the customer through the original payment method or provide store credit. Please be aware that we do not refund international duties or taxes.

Exchanges (if applicable)

Items are eligible for replacement only if they are defective or damaged.

Gifts

If the item was designated as a gift during purchase and sent directly to you, you will receive a gift credit for the returned item’s value. 

Upon receiving the returned item, a gift certificate will be sent to you.

In cases where the item was not identified as a gift during purchase, or if the gift giver had the order shipped to themselves to give to you later, a refund will be issued to the gift giver, who will be notified of the return.

Sale Items (if applicable)

Refunds are only applicable to regular priced items as sale items are non-refundable.

Late or Missing Refunds (if applicable)

If you have not received your refund, start by rechecking your bank account.

Reach out to your credit card company as it may take some time for the refund to be officially posted.

Contact your bank next, as there is usually a processing period before refunds are posted.

If you have completed these steps and have still not received your refund, please get in touch with us at distribute@blancobridal.com.

Refunds (if applicable)

Upon receiving and inspecting your return, an email will be sent to inform you about the receipt of your item. You will also be informed about the approval or rejection of your refund. If approved, the refund will be processed, and a credit will be automatically applied to your credit card or original payment method within a specified number of days.

Sales Admission

Wedding Couture reserves the right to decline any sale, which could stem from outdated information, website breaches, or fraudulent transactions. Full payment will be reimbursed within 10 business days of purchas

Alterations

Alterations Terms and Conditions

 

These Terms of Services (“Terms”) constitute the entire understanding and agreement between the Client (“the Client”) and Margin Capital (Pty)Ltd trading as Wedding Couture and its affiliates (“Wedding Couture”) relating to the purchase of the garment alterations described on the quote (the “Services”) and supersedes and replaces any and all prior agreements, whether written or oral, that may exist between them with respect thereto.

Deposits and Invoicing.

After the first fitting, a non-refundable deposit of at least fifty percent (50%) of the base quote is due.  Any changes in Client’s measurements after the first fitting which cause additional or different Services to be rendered are subject to additional charges.

The Client presumes all responsibility over any weight gain or loss that may affect the way a garment fits.  Clients who come more than 6 weeks before their weddings do so at their own understanding that Wedding Couture cannot control for changes in fit due to body fluctuations after the final fitting has commenced. Any changes that need to be made after the third fitting is subject to additional alterations costs, additional appointments, etc. Clients who choose to come early do so at their own financial risk.  Dry cleaning, steaming, and pressing are separate services that are not included in base alterations services. The base quote is subject to change if the Client requests changes after the initial consultation (including those needed due to weight fluctuations or changes in shoes) or additional materials are required.  Any changes in heel height are subject to additional re-fitting charges. The second half of the invoice is due at the final fitting or time of pickup. All alterations and dress care agreements are final – no refunds or exchanges are given.

Any accessories purchased in-studio are non-refundable.

 

 

Fittings, Acceptance.

Wedding Couture will begin to perform the Services upon receiving the deposit.

Services provided are based on the measurements provided at the time of the Client’s first fitting.  Any measurements set forth on the invoice shall be conclusive evidence of the Client’s measurements at the time of the first fitting.  Wedding Couture cannot be held responsible for dresses that do not fit properly due to weight loss or gain, pregnancy, surgery, failure to wear the same shoes or undergarments from the first fitting, etc.

Clients are advised to not introduce any major lifestyle changes that may influence body weight and type as not to disrupt the fitting process.

Wedding Couture will execute the tailoring work as discussed during fittings; if a seam cannot be opened or sewn, or if any alteration technique is deemed high-risk yet the client chooses to proceed, this is done at the client’s own risk.  Some garments may be unalterable or unalterable in certain areas.  Techniques and approaches are taken at the discretion of Wedding Couture.  The client expresses acknowledgement that altering a dress is a deliberate modification to the dress, and not all alterations can be undone.

Any cancellations or reschedules of first, second, third, or final fittings made within 48 hours are subject to a R400 appointment fee.  Clients who miss 50% or more of the allotted appointment time will be charged the late fee and will need to reschedule their fittings.  Any additional elective appointments requested by the Client outside the standard 3 fittings will incur a R400 appointment fee. This includes appointments for refittings, change of mind, appointment to try accessories, etc.  Clients who decide to pick-up their dresses earlier or cancel alterations (if possible) will not be able to recover the deposit and will be liable for cancellation fees, and agree to accept their dresses in their unfinished state.

All concerns or complaints are to be addressed with Wedding Couture during the fitting process and before the final fitting.  In the event of a disagreement, any and all resolutions will be at the discretion and sole responsibility of Wedding Couture.  Should the Client neglect to come for a scheduled fitting, Wedding Couture is not liable for the fit or finish work of the garment.

Customizations.

Any customization in the design of a garment, are based on the information provided at the time of Client’s initial request for such customization. Some requested customizations may not be technically feasible or may be considered high-risk, and Wedding Couture cannot be held liable for changes to the dress if the client consents to such changes.  Any changes in the design by the Client after this initial request are subject to additional charges, or may not be able to be completed. Diagrams and fitting notes will serve as the written record for customization requests.

Any dress customizations made outside of the structure of the garment as received (i.e. original seams) are performed at the Client’s own risk. Clients may be held responsible for acquiring the proper materials (additional fabric, beads, straps, sleeves, etc.) for customizations and may be charged separately if those materials must be acquired on the client’s behalf.  Wedding Couture is not responsible for any liaising between the client and a third-party providing materials; the responsibility and risk is ultimately assumed by the client.

 

Pickup, Delivery.

All accounts must be paid in full before the Client’s dress can be released. If the Client would like another party to pick up the garment on their behalf, Wedding Couture must receive expressed permission and consent with that party’s name. Acceptance of and satisfaction with the Services shall automatically be deemed to have occurred upon the earlier of Client or surrogate receipt of garment.

Once the dress leaves Wedding Couture’s possession, the store and the tailors are not held responsible for the gown. This includes, but is not limited to wrinkling, stains, wear and tear from ceremony and/or reception, bustles falling out from being stepped on, etc. The Client shall inspect the garment upon final fitting and pick-up; Wedding Couture cannot be held responsible for fit and wear once the garment leaves the premises. Final pick-ups are interpreted as acceptance.

Any dresses that do not have a fully paid deposit (or bounced payment) become possession of Wedding Couture after six months. Unclaimed dresses become possession of Wedding Couture after six months. The dress may be released at full discretion of Wedding Couture after the final balance and any late fees have been fully paid. Garments not picked up for 30 days will incur a storage fee may. Any garment not picked up for 6 months may be donated to charity.

Warranty Disclaimer

The Client acknowledges Wedding Couture makes no guarantee as to the fit of any garments before or after services are performed. Unless otherwise expressly provided herein, all services are provided as-is, and Wedding Couture hereby disclaims any and all representations and warranties, express or implied, including without limitation the warranty of merchantability, fitness of a particular purpose.

Limitation of Liability

In no event will Wedding Couture be held liable for any indirect, incidental, special, punitive, consequential, exemplary or similar damages including without limitation, lost profits, loss of use, pain and suffering or mental anguish, related to or arising out of the Services provided. In no event will Wedding Couture be held liable for any direct damages related to or arising out of the services in excess of the price paid by the Client for the service which is the subject of the claim.

Wedding Couture shall assume no responsibility, whatsoever, for any damages caused to members or third parties as a result of the stoppage of services to a member to whom any of the previous provisions apply.

 

Force Majeure

Any delay or failure in the performance by Wedding Couture shall be excused if and to the extent caused by the occurrence of a Force Majeure. Force Majeure shall mean a cause or event that is not reasonably caused by or under the control of Wedding Couture, including acts of God, fires, floods, explosions, riots, wars, hurricane, terrorism, vandalism, governmental acts, injunctions, labour strikes, and errors or omissions of a manufacturer or its distributor.

 

Right of Refusal.

Wedding Couture, affiliates, and contracted agents reserve the right to refuse alteration services or sales to any individual under any circumstances at any time.

Website Content.

Information provided on this website is for information purposes only. It is believed to be reliable, but we do not warrant its completeness, timeliness or accuracy. User and Client accesses, uses, and relies upon such content at User’s/Client’s own risk.

 

COVID-19 Addendum.

Client understands that Wedding Couture works to maintain a safe work environment, including but not limited to, complying with applicable governmental laws, directives, orders, and regulations (each a “Governmental Order”). Client further understands and agrees that Wedding Couture shall not be required to perform under this Agreement if the Event is held in violation of a Governmental Order or Wedding Couture’s participation in the Event would violate a Governmental Order. Client understands that deposits remain non-refundable and the fitting process will not be extended to accommodate any reschedules in wedding dates. By signing this agreement, client understands that cancellations may not be possible and they will be responsible for covering the full costs of alterations. Wedding Couture will not hold dresses after alterations have been complete, and the final balance will be due when the work has been completed.

While under the COVID-19 operating protocol, Wedding Couture will minimize the number of appointments needed; fittings are completed when the dress is released back to client (even if this is just one or two fittings). If the wedding or event is rescheduled or postponed, the fitting process cannot be elongated or stretched out. Wedding Couture is not able to provide dress storage and clients must pickup their dresses after the 3-4 month standard period. Wedding Couture is not responsible for changes in fit after the 3-4 month standard period from first fitting and/or once the dress has been taken home.

 

Terms and Conditions Revisions

Wedding Couture reserves the right to change these terms and conditions at any time without prior notice; Wedding Couture may change, add, suspend, cancel, remove or otherwise modify the services offered at any time without prior notice. Any such modification will be effective immediately upon public posting (www.blancobridal.com/terms-and-conditions). Your continued use of our Service and this Site following any such modification constitutes your acceptance of these modified Terms.

Clients who book an appointment with Wedding Couture must agree to these terms and conditions to receive service with Wedding Couture. The parties agree that this agreement may be electronically signed (as agreed to upon booking). The parties agree that the electronic confirmation offered at time of appointment booking are the same as handwritten signatures for the purposes of validity, enforceability, and admissibility. Clients who book an appointment with Wedding Couture must agree to these terms and conditions to receive service with Wedding Couture.

 

ADDITIONAL TERMS RE: CLEANING, STEAMING, PRESSING, AND PRESERVATION

 

Deposits and Invoicing.

Dry cleaning, steaming, and pressing are separate services that are not included in base tailoring services. Any fees are due at time of drop-off and are non-refundable. All alterations and dress care agreements are final – no refunds or exchanges are given. Any accessories purchased in-studio are non-refundable.

 

Process, Acceptance.

We exercise utmost care in processing articles entrusted to us and use such processes which, in our opinion, are best suited to the nature and condition of each individual article. Nevertheless, we cannot assume responsibility for inherent weaknesses of or defects in materials that are not readily apparent prior to processing. This applies particularly, but not exclusively, to suedes, leathers, silks, satins, double-faced fabrics, vinyl, polyurethanes, etc. Responsibility also is disclaimed for trimmings, buckles, beads, buttons, bells and sequins. In laundering item(s) are not inspected, therefore we will not be responsible for any claims, including shrinkage, discolouring, runs, rips, tears, or any other damage. Note that dress cleaning, pressing, steaming may change the texture of certain fabrics and garments. Depending on the composition of gown, some dresses may be hand or wet cleaned as opposed to dry cleaning, reviewed on a case-by-case basis and fabric care guidelines. to Cleaning risks are assumed by the client alone.

Wedding Couture is not responsible for any staining, damage, or wrinkling after the point of pick-up. This includes long-term care for wedding dresses that are cleaned and/or preserved, as many variables outside of our control can contribute to aging and wear/tear.
